Common Zoning Violations

Review the list of common zoning violations below to help you determine if a violation exists, and what type of violation it may be. There are many conditions on a property that may be in violation of Provo City's Zoning, Land Use and Development, Health & Sanitation, Business Licensing or other ordinances as administered under the Administrative Enforcement Program. Some conditions are more common than others. Violations may be reported by submitting a zoning complaint online, or calling the Zoning Division at (801) 852-6400.

Junk, Trash, Weeds, Inoperable VehiclesSection 14.34.080 provides a description of violations that fall into this general category. When inoperable vehicles (includes unlicensed, unregistered vehicles) are stored on private property in open areas, there may be a zoning violation. Inoperable, unlicensed, or unregistered vehicles stored on a public street must be reported to the non-emergency Police dispatch office at (801) 852-6211 for enforcement.

Rental License ViolationsSection 6.26 contains regulations for rental licenses. All properties in Provo that are not occupied by the owner are considered rental properties and must be licensed by Provo City. Rental license applications are reviewed by the Zoning Division for compliance with land use, minimum health and safety, occupancy, and parking. Properties that are being loaned, leased, or rented whether or not there is a monetary exchange, are deemed rental properties and require a license. Apply for a Rental Dwelling License.

Non-Permitted UsesZones throughout the city determine how land can be used. For example, residential zones generally do not permit commercial uses. Some commercial zones do not permit residential uses. Some residential zones permit accessory apartments, while other residential zones do not permit accessory apartments. For information on permitted uses in a zone, you may access the city's interactive map to find the zone, then refer to the city code to determine which uses are permitted or conditional in that zone. To obtain the most accurate information on permitted uses, call the Zoning Division at (801) 852-6400 or request a Zone Verification by filling out the Zone Verification form and submitting it to the Community Development Department, along with the $25 fee. Zone Verification requests may be submitted in person at 330 W 100 S, Provo, or via fax at (801) 852-6417, or email the Zoning Secretary. Credit card payments can be made over the phone by calling (801) 852-6400.

The best way to determine whether a property complies with occupancy restrictions is to call the Zoning Division at (801) 852-6400 or request a Zone Verification. Even within the same zone properties may have different occupancy allowances based on when the home, condo, or other structure was built. Request a Zone Verification by completing the Zone Verification form and submitting it to the Community Development Department, along with the $25 fee.
