Chapter 2.05 Campaign Finance Disclosure

2.05.010 - Definitions

(2) Campaign Committee: Political committee appointed by a particular candidate to act for the candidate.

(4) Contribution:

a) Gift, subscription, loan advance or deposit of money (except bank loan)

b) Contract, promise or agreement to make a contribution

c) Transfer of funds between political committees and candidates campaign committee

d) Payment for the personal services of another person by a person other than the candidate’s campaign committee for services rendered to the candidate

e) Does not include volunteer time on behalf of the candidate.

(8) Political Committee: two or more persons cooperating to aid or promote the success or defeat of a candidate, including making donations to the campaign committee.

(10) Political Purpose - an act done to influence, directly or indirectly, the election of a candidate

2.05.020 - Contributions to Candidates - Limitations

(1) No cash contributions exceeding $50.00. Checks or bank draft may be unlimited.

(2) No anonymous contributions - shall be transmitted to city treasure for deposit into general fund.

2.05. 030 - Contributions in the Name of Another is prohibited.

2.05.040 - Campaign Financing Disclosure Statements

(1) File with City Recorder

a) Seven days immediately before the primary election (by 5 p.m. on September 27)

b) Unsuccessful Primary Election candidates shall file within 30 days following the Primary Election (prior to or before 5 p.m. November 3)

c) General Election candidates shall file 7 days preceding the General Election (by 5 p.m. on November 1)

d) All General Election candidates shall file a report 30 days following the General Election (prior to or by 5 p.m. on December 9)

e) Any contribution received after last report shall be filed every 90 days until committees cease operations.

(2) Each contribution received by a candidate, campaign committee, or political committee shall be reported in at least one of the campaign disclosure statements

(3) Statements shall include:

a) Name of contributor and amount of any contribution more that $50.00. (Aggregate total of contributions of $50.00 or less.)

b) Name and recipient for each expenditure.

2.05.060 Unlawful Acts

(1) Cannot administer oath of office to any candidate until financial disclosure statements are filed

(2) Misdemeanor for failure to file.

 

FINANCIAL CAMPAIGN DISCLOSURE
DATES TO REMEMBER

PRIMARY ELECTION

September 27, 2005: First financial disclosure statements for all candidates are due to the City Recorder by 5:00 p.m. on this date.

November 3, 2005: Final disclosure statements from candidates who were unsuccessful in the primary election are due prior to or by 5:00 p.m. on this date.

GENERAL ELECTION

November 1, 2005: Second financial disclosure statements from those who were successful in the primary election are due to City Recorder by 5:00 p.m. on this date.

December 9, 2005: Final financial disclosure statements* from all candidates in the general election are due prior to or by 5:00 p.m. on this date.
