TERMS & CONDITIONS
GENERAL: All property is offered “AS IS, WHERE-IS” with no warranty or guarantee, expressed or implied, as to the properties condition for use. Provo City is not responsible for any omissions or errors in the description of property being offered for sale. The description of property was done by personnel untrained in these areas. Photos are merely representative of the property and may not be relied upon for disclosure of all defects. Bidders should inspect property prior to submitting bids. Bidders must adhere to the inspection dates and times indicated in the item description or contact the person listed to schedule an inspection. ALL SALES ARE FINAL with no refunds or exchanges. Provo City reserves the right to reject any/or all bids and to withdraw an item at any time.
Bidder agrees for and on behalf of bidder, bidder's heirs, successors and assigns that bidder shall indemnify and hold Provo City harmless from and against any claim, demand or cause of action arising or alleged to have arisen out of the sale or failure to sell any item including claims for personal or bodily injury, death or contract damages.
PAYMENT TERMS: Successful Buyer will be required to remit payment within five (5) business days and remove property within ten (10) days from close of auction. Buyer will also be responsible for cost of shipping item(s) if necessary. Please provide own personnel for loading.
Provo City will accept the following payments: Cash (U. S. currency only), Cashiers Check, Certified Check, Wire Transfer, or Money Order (made out to Provo City) Payment must be made to the Treasury Division located at 351 W Center, Provo, UT 84601, prior to pickup of property. Identify item(s) being purchased when submitting payment.

VEHICLES: Successful bidder assumes responsibility for all applicable taxes. Sales tax will be paid to Utah State Tax Commission at the time of title transfer. Buyers will receive the title upon payment, and must transfer the title immediately.
DEFAULT: Bidders may be barred from participating in Provo City sales for failure to observe the Terms and Conditions. By submitting a bid, the bidder agrees that they have read, fully understand and accept the Terms and Conditions of Online Sales and agree to pay for and remove the property, if the bid is accepted, by the dates and times specified.
Terms & Conditions for Vehicles
- Do not place bids for items you do not intend to purchase. Results are posted on the Public Surplus site. Bidders who do not pay for and pick up items they've won will be barred from participating in future auctions.
- Bidders must be at least 18 years of age and possess a valid driver's license.
- Pursuant to Utah Code 41-3-102, anyone purchasing more than three vehicles in any 12-month period must have a valid dealer's license.
- (Vehicles) Potential bidders are advised that physical inspection of the sale items will be accommodated. The inspection period is limited to Monday - Thursday, between the hours of 8:00 a.m. to 11:30 a.m. and 1:00 p.m. to 5:00 p.m. Mountain Time, at the Fleet Division, Public Works Building, 1377 South 350 East, Provo, UT 84606. During the inspection period, vehicles will be started on request, but will not be driven. Bidders are responsible for viewing the items prior to the closing date for acceptance of bids. If a bidder cannot view at the specified time, contact Brent Holman at bholman@provo.utah.gov or 801-852-6710, to arrange an alternate viewing time.

- Vehicles must be paid for and picked up no later than ten days after award of Bid. After this time a storage fee will be assessed daily until the vehicle is picked up.
