ADA Grievance Procedure


It is the policy of Provo City to use the following by all persons who wish to file complaints alleging violations of the Americans with Disabilities Act of 1990 (42 U.S.C. Sec. 12101). 

1. Complaints 

a. Any person alleging denial of reasonable accommodation, denial of program accessibility, or discrimination under the provisions of the Americans with Disabilities Act of 1990 (ADA) may file a complaint, in writing, with the office of the Provo City ADA Coordinator in the Department of Human Resources. The ADA Coordinator will conduct an investigation of the circumstances and merits of the complaint, and shall file a report of action with the complainant, the ADA Coordinating Committee, and the Office of the Mayor, within twenty one (21) calendar days. A record of the complaint and action taken will be maintained. 

b. The ADA Coordinator is empowered to act as a mediator between the complainant and the individual or department subject of the complaint in order to achieve a resolution of the complaint as quickly and effectively as possible. 

2. ADA Coordinating Committee 

a. If the complaint cannot be resolved to the satisfaction of the complainant by the ADA Coordinator within the time specified above, it may be appealed, in writing, to the ADA Coordinating Committee. The ADA Coordinating Committee will be composed of department representative, facilities and building code specialists, representatives of the disabled community, and business and civic leaders, as appointed by the Mayor for terms of one year from the time of appointment. 

b. The Committee is charged with establishing rules of procedure for the conduct of hearings. For the purpose of hearing complaints only, the Committee shall be chaired by the Director of Human Resources. For the conduct of all other business, the Committee shall be chaired by the ADA Coordinator. When hearing complaints only, the public notice procedure of the Open and Public Meetings Act (Chapter 52-4-6) of the Utah Code shall be followed. The Committee shall issue a written decision to the complainant and the Office of the Mayor within twenty eight (28) calendar days. All proceedings and actions of the Committee shall be recorded and maintained.
